Approve Referendum 67: Make the Insurance Industry Treat Consumers Fairly.

Insurance delays destroy injured man’s credit

Marshall Ness was hit by a drunk driver while walking to his car on crutches in March 2002. The driver had no insurance.

Marshall’s insurance company, Farmers Insurance, wrongfully denied Marshall’s claim for treatment and medical bills totaling more than $8,000. Marshall’s doctor recommended surgery to fix the herniated disc injury. But Farmers' repeated delayed and denied approval for Marshall’s mounting medical bills and surgery. He became financially and physically devastated.

Marshall did not have health insurance so his unpaid doctors began denying Marshal further care because of his delinquent accounts. He was also denied a home loan because brokers told Marshall it appeared he had potential insurance fraud on his credit record.

Marshall finally contacted an attorney and the Office of the Insurance Commissioner. Farmers settled his claim more than three years later.
