No. Existing law does not prevent insurance companies from treating consumers unfairly. Right now, if you have to resort to suing your own insurance company, all the insurer has to pay is what they owed you in the first place. You have to pay your legal costs out of your own pocket, plus cover the auto or home damage that your insurance company should have covered. Insurance companies earn interest by unreasonably delaying and denying legitimate claims – it pays to delay and deny.
R-67 would require that the insurance industry to pay legitimate claims in a reasonable and timely manner or they could be subject to court-approved damages of up to three times the original claim plus attorney’s fees.
